Congress is moving quickly on the GUARD Act, with a key vote expected this Thursday. This bill is being pitched as a way to protect kids from harmful AI chatbots. In reality, it goes much further, and could require tools as basic as search engines to put up age gates for everyone.
The GUARD Act would require companies to verify the age of every user before allowing them to use many AI-powered tools. That means uploading a government ID or other sensitive data just to ask a question online. It would also block anyone under 18 from using a wide range of everyday tools—from homework help to customer service chats.
This approach won’t help keep people safe. Instead, it creates new problems:
- Privacy Risks: Age verification systems require gathering sensitive personal data, creating targets for breaches and undermining anonymity online.
- Broad Restrictions: Teens could be locked out of tools they already rely on for school, everyday tasks, and basic information.
- Vague Rules + Heavy Penalties: Unclear definitions and steep fines will push companies to block access or limit features even when the law doesn’t clearly require it.
There are real concerns about harms caused by AI systems, especially for young people. But the GUARD Act responds with a blunt, overbroad solution that sacrifices privacy and access for all, without addressing the risks directly
