My friend Katie Phang sued acting Attorney General Todd Blanche earlier this week. She contends that the failure of Acting Attorney General Todd Blanche and the Justice Department to comply with the Epstein Files Transparency Act interferes with her role as a journalist and her ability to report. It’s a novel theory, but one that’s very elegant, and it’s the first lawsuit of its type—an example of how the legal profession can morph to counter the challenges to the rule of law that this administration poses. The case may help with the survivors’ search for justice, but because it’s been filed so recently, not much is known yet about the reception it will get from the courts.
