I joined Jim Acosta this afternoon to discuss the reporting that DOJ has an open criminal investigation into E. Jean Carroll. After our conversation, the U.S. Attorney in Chicago, Andre Boutros, issued a very carefully worded statement denying that he had a case open on her. Jim and I had anticipated that this might be where the reporting was headed, and discussed the dynamics around the investigation and why prior litigation almost certainly forecloses the possibility of indicting Carroll for perjury, based on an answer given during a civil deposition.
