However, some critics argue the new rules restrict access to personal funds.
Kerala High Court recently ruled in favor of employees seeking higher pension. EPFO had denied claims due to bulk contributions made by the employer. The court found that contributions were accepted, despite timing irregularities. It stated that procedural issues cannot deny employees their substantive right to higher pension. This judgment reinforces that EPFO must prioritise substance over form.
